Protecting your privacy

Momentum OT (previously Momentum Rehab) is committed to protecting your privacy and to maintaining the confidentiality, accuracy and security of your personal information. We are guided in this by the relevant Australian and NSW Privacy laws and by Health Practitioner Regulations and Codes of Conduct.

What is personal information?

Personal information is any information that identifies you and is about you. If information has been de-identified, making it no longer possible to identify you, then it is no longer considered to be personal.

Your health information is personal information and can include details of your past, present and future physical and mental health or disability.

What information do we collect and why?

Momentum OT (previously Momentum Rehab) is required to collect personal information that is reasonably necessary for, and directly relevant to, the services we provide.

We use the information we collect to provide you with the best possible service, using it to accurately assess your needs so we can undertake effective activities and services to best meet them.

Information may be collected in several ways and from a variety of sources. Personal information will be held securely for a minimum of seven years after which time we are permitted to either destroy or de-identify your record.  Clinical notes and other documentation are stored in a highly secure, cloud-based, multi-factor authenticated system called iinsight.  Any physical (hardcopy) records are destroyed confidentially through a secure shredding service.

How do we use your personal information?

Momentum OT (previously Momentum Rehab) will only use personal information to conduct business activities and deliver services that meet your needs and interests. This may involve disclosing information to others that have a legitimate and lawful role in the provision of our services.

This may include: your insurance company; medical and health practitioners; your employers – past and present; legal practitioners; our contracted advisors & service providers; Government departments, law enforcement agencies and official NDIS auditors as part of the  NDIS Quality and Safeguards Commission.

We will only disclose personal information when you have given us consent to do so or when we are lawfully required or authorized to do so.

We shall take all reasonable steps to ensure that the personal information we collect and deal with is accurate and up to date.

Giving consent to collect your information 

You will be asked to provide written consent for us to collect and handle your personal information. You may nominate which individuals or organizations you would like us to share your personal information with.  You may nominate an advocate to act on your behalf.

When you provide consent, you should be confident that:

  •  You understand what giving consent means
  • You have been clearly told about our privacy policy
  • You are aware of the information we require and why
  • You are giving your consent voluntarily
  • You can tell us of any concerns about your privacy

You may refuse or withdraw your consent at any time, either verbally or in writing, and include your concerns and reasons.

If you do withdraw consent, Momentum OT (previously Momentum Rehab) will be unable to continue to provide services to you.

Accessing your personal information

As long as there are no circumstances in which Momentum OT (previously Momentum Rehab) may be lawfully required or authorised to withhold access to your personal information, you will be provided with access to your personal information on receiving your written or verbal request, and after verifying your identity.

We may refuse access if your request for information is found to be frivolous or vexatious.  If we refuse your request for access, we will give you written notice explaining the reasons why.

Complaints about the privacy of your personal information

If there is a concern about how we have handled your privacy; and you have been unable to resolve it through discussion with our consultant, you can take your complaint to the company Director.
